Spotts Fain’s collections department was founded in the early 1970’s at a predecessor firm.  Our attorneys and staff have extensive experience in both retail and commercial collections.  We manage every aspect of the collections process.

Our clients range from Fortune 50 lenders to local businesses and include banks and credit card issuers, as well as physicians and other professionals, leasing companies, other local and statewide lenders and businesses of every kind.  We have particularly extensive experience in bank card, consumer loan and vehicle deficiency collections and its related litigation.  Our collections department complements the firm’s larger creditors’ rights section, which provides creditor representation in bankruptcy, foreclosures, litigation, workouts and other actions.

Fair Debt Collection Practices Act Compliance

We take complying with the FDCPA very seriously for cases to which it pertains.  We have a detailed training program for our attorneys and staff.  Our continuous self-monitoring process is designed to ensure that all debtors are dealt with fairly, courteously and in accordance with state and federal law.  In addition, we are cognizant of both our obligations and creditors’ obligations under other statutes, including the Fair Credit Reporting Act and the Fair and Accurate Credit Transactions Act.

Monetary Protestors, False Arbitration And Other Bogus Defenses

Our attorneys have extensive experience with debtors advancing specious defenses to valid debts.  We have tried these cases throughout the Commonwealth with much success.  A significant number of these deal with false arbitration awards entered by sham arbitration companies located throughout the United States.  In dealing with these false arbitrations, we use our thorough understanding of both the Federal Arbitration Act and the Virginia Arbitration Act.  We stand ready to protect your accounts from any and all improper defenses, no matter how creative.

Technology

Spotts Fain uses a state of the art computer system with new workstations on the desk of every attorney and collector on staff.  We believe in the efficiencies that reliable technology can bring to the collections process. 

Security and Disaster Preparedness

All of our offices are secured from outside intrusion.  We have undergone rigorous security testing from a number of our clients and have in place a Continuity of Business Plan.  We also have a detailed Information Security Policy to ensure that confidential customer or consumer information is protected from unauthorized access.  In furtherance of this policy, we make extensive use of encryption software.

We are members of the National Association of Retail Collection Attorneys (“NARCA”), the Virginia Creditors Bar Association  and the Debt Buyers' Association.
